Petition challenging Muslim Personal Law before Apex Court

Ashwini Upadhyay, BJP leader and Supreme Court has approached the Apex Court to look into issues of polygamy and nikah-halala. The contention is that nikah halala is rape under Section 375 of the IPC and polygamy is an offence under Section 494 of the IPC. Further,  it is claimed that these two practices as personal law remains subservient to the Constitution and that India does not need “another personal law.” It also requests the Hon’ble Court to implement the Uniform Civil Code.

The matter is to be heard on March 16,2018.
